1. About these Terms
These Terms of Use ("Terms") govern your access to and use of the WaterBear website, streaming platform, and related services (collectively, the "Service"), operated by OurFrame SA, a company incorporated under Swiss law, with its registered office in Geneva, Switzerland ("OurFrame", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
The Service includes the WaterBear website (the "Site") and the WaterBear streaming experience hosted on our video platform (the "Platform"), accessible via web browsers and, where available, dedicated television applications.
2. Eligibility
You must be at least 16 years old to create an account and use the Service. By creating an account, you represent that you meet this age requirement.
If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian.
3. Account Registration
Access to the Platform requires the creation of a user account. You agree to provide accurate and complete information during registration and to keep your account credentials secure.
You are responsible for all activity that occurs under your account. If you suspect unauthorised access, please contact us immediately at privacy@ourframe.ch.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. The Service
WaterBear is a nature and environment streaming service. The Service provides access to a curated catalogue of films, documentaries, and related video content, free of charge.
Content is provided on a free-to-watch (FVOD) basis. We reserve the right to introduce paid features, subscriptions, or other monetisation models in the future, with appropriate notice.
The catalogue, features, and availability of the Service may change at any time without prior notice.
5. Acceptable Use
You agree not to:
use the Service for any unlawful purpose;
attempt to gain unauthorised access to any part of the Service or its systems;
reproduce, distribute, publicly display, or create derivative works from any content available on the Service, unless explicitly permitted;
use automated tools, bots, or scraping mechanisms to access the Service;
interfere with or disrupt the Service or its infrastructure;
impersonate any person or entity, or misrepresent your affiliation with any person or entity.
6. Intellectual Property
All content available on the Service, including but not limited to videos, images, text, logos, trademarks, and software, is the property of OurFrame SA, its licensors, or its content partners, and is protected by applicable intellectual property laws.
The WaterBear name and logo are trademarks of OurFrame SA.
Nothing in these Terms grants you any right, title, or interest in the Service or its content beyond the limited right to use the Service in accordance with these Terms.
7. Third-Party Services
The Service relies on third-party providers for video hosting, streaming delivery, and other technical functions. Your use of the Service may be subject to the terms and policies of these providers, in particular:
Vimeo, Inc. for video hosting and streaming delivery. Vimeo's terms of service apply to the extent relevant to your use of the streaming platform.
We are not responsible for the practices or content of third-party services.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the fullest extent permitted by applicable law, OurFrame SA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed CHF 100.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
For material changes, we will make reasonable efforts to notify you via email or through the Service.
11. Termination
You may stop using the Service and delete your account at any time.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws provisions.
Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Geneva, Switzerland.
